Defence lawyers have discovered that the woman at the centre of the case also made a similiar claims to police back in '96. She claimed she was attacked and raped by three men when she was fourteen in an unspecified location in Creedmore, about fourteen miles from Durham. The men were never arrested and no details as to why not have been released. Mike Nifong has not released a statement.

i see this imbroglio simmering down to nothing more than a vapid made-for-TV movie. it won't even matter which side's at fault.
ReplyDeleteI don't know Finn, if it turns out that this girl is lying about being raped, then she had created some serious damage to the lives of those player- not that they are completely innocent in all this either. But not being completely innocent and being rapists are very removed.
ReplyDeleteWell, fuck all that kerfuffle. If she is lying, she is doing women everywhere a disservice; the genuine cases already have women put through the wringer bigtime - which is why so many cases go unreported.
ReplyDeleteHmmmm I don't know about this one. One of the many things I don't like about how rape cases are handled is how the sexual life of the victim or the alleged victim is dragged out for all to see, yet those accused are never questioned about the same. (I can't find the link but recently a judge said that a rape case was "worse" for a girl because she was a virgin - the insinuation being that if she hadn't been a virgin it would have been alright, which I found disgraceful.)
ReplyDeleteIf evidence came out that these guys had been involved in something like this before would it be brought up in court? I'm not a lawyer, but as far as I know, they can only be tried for this alleged offence and no other. Which, I understand, is fair enough..but how then can they justify bringing up the past of the alleged victim? Shouldn't she have to answer for this case alone? (If I'm wrong about this, please do correct me.)
Shouldn't it be, regardless of what went on before, the evidence relating to this incident ONLY that is brought before the courts? Perhaps she did bring false accusations before, but that doesn't mean she's doing it now and personally I dont' think any previous events should be made part of this investigation.
Kaz, I agree, to a point. She is a stripper and in a high risk situation for rape. There is bound to be more than one occasion where she felt threatened and maybe she has been raped in the past.
ReplyDeleteIt is also possible though that she has frivolously stained these, albeit unsympathetic, characters in an indelible way.
We will probably never know, so it's hard to see how far the legal system can resolve anything in this case. What a mess.
If anything though, this might rein in how other frat-boys behave towards the strippers they hire. That's the only good I can see coming out of the case at the moment.

ReplyDeleteThe larcosse team are no lambs, they were drunk, there was a large number of them at the party, they hired two strippers privately, meaning away from prying eyes of a club and bouncers, they left themselves wide open for an accusation.
However there is no DNA evidence, the woman could not identify her attackers, she was found to be so drunk not long after the incident that a police officer could not rouse her, and the lady with her did not see or hear the alleged attack, and now this earlier claim, which will set the cat amongst the pigeons-if that isn't being to glib.
Like I said before it is a mess and I am doing my level best to keep an open mind and following it as best I can becasue this case has ripped open a seam in middle America and I am facinated by the battle lines drawn.
